OPERATIONAL TERMS & CONDITIONS

Payments:

	All NZV8 Hot Lap participation payments are required to be remitted in full at the time of buying the gift voucher and/or confirming the booking & prior to the commencement of the Hot Laps.
	Advanced Driving Systems Limited accepts the following forms of payment: Visa MasterCard Cash Internet Banking Cheque

Attendance:

	Please Note: Refunds or "Credits" can not and will not be made for non arrivals... Participant substitutions can be made any time prior to the commencement of the Hot Laps.
	Please Note: No Cash Refunds will be made on any open dated gift certificates or issued vouchers... Once a voucher is issued, the terms of issue must be fully complied with, in order to validate the voucher. Any voucher must be pre-booked onto an available pre-programmed NZV8 Hot Lap event date and must be fully physically completed prior to the expiration date of the voucher. No extensions or excuses will be entertained.
	Please Note: Any failure and/or inability (for what ever reason) of you physically attending at the pre-booked and specifically allocated date and arrival time, will unfortunately result in the forfeiture and invalidation of your V8 Hot Lap ride experience due to your non-attendance or late arrival.
	Please Note: Please don't even bother asking if we can just "bend" or "ignore" our standard operating terms & conditions, due to you being "busy", or you "forgot", or some other issue you may personally have... (If you fail to attend as required or you just don't get around to using it... then you lose it)
	Please Note: Our pre-programmed and pre-booked V8 Hot Lap rides are generally conducted in all normal prevailing weather conditions... wet and/or fine
	Please Note: Our 400kw Holden V8 Hot Laps are a high-speed ride activity... It is therefore recommended and suggested that any intending participants who may have any severe heart conditions, severe back/head/neck conditions, are in the advanced stages of pregnancy and/or any other similar applicable conditions, should consider their own personal circumstances prior to undertaking this activity.
	Please Note: Our 400kw Holden V8 Hot Laps rides are suitable for participants of all ages... To date, our youngest ride participant has been 6yrs old and our oldest ride participant has been 87yrs old. Any participants under the age of 18yrs will require the approval of a parent or guardian.
	Please Note: As with all things mechanical, on some vary rare occasions there may be operational delays experienced which may occur from time to time. The total safety of our clients, staff and vehicles is absolutely paramount and in the event of any mechanical or operational issues what so ever that may require attention, it will be immediately positively attended to. We will at all times try our best to operate and conduct our V8 Hot Lap activities to the indicative times provided, however... there may be occasions where delays are experienced due to circumstances beyond our physical control. We apologise in advance for any delay or inconvenience which may subsequently result.
	Please Note: If at any time thru substantially inclement weather or deteriorating track/vehicle conditions, NZV8 Hot Laps deems that it may be unsafe or imprudent to continue or proceed... then your V8 Hot Laps session will be terminated (forthwith) and it may subsequently be postponed or rescheduled to a later date/time. (As appropriate and suitable in the prevailing circumstances of the specific individual case, at the absolute discretion of the NZV8 Hot Laps organisers)
	Please Note: In the event of mechanical issues, weather issues or any other operational issues, causing your booked activity attendance to be postponed and subsequently rescheduled to an alternate date/time, NZV8 Hot Laps are not liable for any additional participant costs or expenses incurred. (Refunds and/or expenses outside of our originally applicable standard operating terms and conditions in respect of any travel, accommodation and/or other expenses etc will not be entertained... However, an opportunity to undertake on a subsequent later date will be offered) (NZV8 Hot Laps and Advanced Driving Systems Limited are not liable for any additional costs what so ever which may be associated with your subsequent re-attendance onto the rescheduled new date.)

Cancellation Fee Schedule:

	8 weeks or more prior to the confirmed Hot Laps session................................ 100% Refund
	4 - 8 weeks prior to the confirmed Hot Laps session......................................... 50% Refund
	Less than 4 weeks prior to the confirmed Hot Laps session............................... NO Refund
	Pre-paid open dated Hot Laps Vouchers are entirely non-refundable.................. NO Refund
	Exclusive Group Hot Laps sessions (once booked)............................................... NO Refund
	Any vouchers that are past their expiry date............ are "expired, invalidated & unusable"

Transfer Fee Schedule:

	Any Hot Laps session transfer request within 28 days of the originally confirmed Hot Laps date will incur an additional Transfer Administration Fee of............. $100 + GST per person
	Any Hot Laps session transfer request within 7 days of the originally confirmed Hot Laps date will not generally be entertained........................................ No Refund & No Transfer
	Any requested amendments to adjust or reschedule previously confirmed Hot Laps session times on the same original date will incur an additional Administration Processing Fee of..... $50 + GST per person
	Consideration and any subsequent approval to transfer confirmed Hot Laps attendance dates is at the sole discretion of the Race Director of NZV8 Hot Laps. His fully informed and considered opinion will subsequently be final and binding. Recipients must at all times abide and fully comply with our standard operating terms and conditions (As are openly published and updated from time to time upon this website).
	Please don't even bother asking if we can just "bend" or "ignore" our standard operating terms & conditions, due to you being "busy", or you "forgot", or some other issue you may personally have...

Gift Vouchers:

Any and all pre-paid V8 Hot Lap gift vouchers are entirely non-refundable.

Any and all pre-paid V8 Hot Lap gift vouchers are able to be "upgraded" to include additional extra laps, with the additional payment of the applicable extra cost.

Any and all pre-paid V8 Hot Lap gift vouchers are able to be "upgraded" and utilised towards the participant undertaking either of our V8 Race Drive Experiences, with the additional payment of the applicable extra cost.

Any gift vouchers that are purchased directly through any other "resellers" of our NZV8 Hot Lap products are issued directly by the resellers and any payments that you have previously made, have been physically made directly to the individual resellers... Not to NZV8 Hot Laps.

In respect of any vouchers that have been issued by any resellers, you must fully comply with all of the applicable terms & conditions of the issuing resellers in order for them to be validated... Additionally, you will also need to fully comply with all of our own NZV8 Hot Laps standard operational terms & conditions
(Which are as published and updated from time to time upon our Hot Laps website)

Any vouchers that have not been redeemed, undertaken and fully completed by their physical expiration date are unfortunately invalidated and are entirely non-usable and non-refundable.

The Hot Laps booking must have been previously confirmed & the activity must be fully completed upon one of our available pre-programmed event dates, prior to the expiry date of any voucher...

Please don't even bother asking if we can just "bend" or "ignore" our standard operating terms & conditions,
due to you being "busy", or you "forgot", or some other issue you may personally have...
(If you fail to attend as required or you just don't get around to using it... then you lose it)

In respect of any pre-paid vouchers that you may have chosen to purchase thru any entirely separate "resellers" of our products, please be aware that any and all payments that you may have already made, have actually been made to the voucher "resellers" and not directly to NZV8 Hot Laps.
In the event that the voucher resellers subsequently fail to physically make payment to NZV8 Hot Laps for our driving services (due to their liquidation or any other failure occurrence on their part) then one of the two following options will become immediately applicable:
(1)    If the "resellers financial failure" is prior to your activity being physically completed...
-    Then their non-paid "resellers" voucher will become immediately invalidated, you will not be able to physically undertake the activity
-    You would then also need to subsequently deal directly with the "reseller" voucher issuer directly in respect getting refunded back any money that you may have already paid directly to the "reseller".
-    You could however rearrange and reconfirm your activity booking by rebooking and paying NZV8 Hot Laps for it directly.
(2)    If the "resellers financial failure" is subsequent to your physically having already completed your booked and programmed drive activity...
-    Then any subsequent non-payment to NZV8 Hot Laps for the driving services that you had already physically received directly from us will leave you personally liable to NZV8 Hot Laps for the outstanding and unpaid fees for the service that you have already physically received from NZV8 Hot Laps.
-    You would then also need to subsequently deal directly with the "reseller" voucher issuer directly in respect of getting refunded back any money that you may have already paid directly to the "reseller".

This type of financial failure and/or liquidation of "voucher resellers" and "cheap deal voucher providers" is not unheard of in New Zealand and can leave their voucher holders substantially out of pocket and unable to redeem their then worthless vouchers...
Example:
-    In January 2010, Total Experience went into a surprise voluntary liquidation and virtually all the money "disappeared" which left thousands of their Total Experience voucher holders without their money and also without the ability to redeem their then totally worthless vouchers.
("If you choose to book and pay directly with a travel agent and the travel agent then goes bust... Then it is not the airlines nor the island resorts responsibility to give you flights and accommodation that they have never been paid for")
-    Choosing to make and pay for your bookings directly with the "service provider" eliminates the middle man and subsequently minimises the likelihood or possibility of this type of thing detrimentally affecting you.
